Getty Images is pursuing an appeal after the High Court rejected its copyright infringement claim against Stability AI. Getty Images alleges that 12 million images were scraped from its website without consent to train and develop Stable Diffusion, Stability AI’s generative AI image model. Nina O’Sullivan, a partner and head knowledge lawyer for contentious matters at Mishcon de Reya, says the Court of Appeal will hear arguments in November. O’Sullivan considers the outcome significant and notes that the dispute could subsequently reach the Supreme Court. The proceedings form part of a wider litigation landscape that the feature describes as comprising more than 150 generative AI copyright cases worldwide, mostly in the United States.

The World Intellectual Property Organization’s Artificial Intelligence Infrastructure Interchange brings together rightsholders, creators, AI developers and technical experts to address practical infrastructure problems associated with AI. Its work covers metadata, identification, attribution, watermarking, fingerprinting, rights management, provenance and AI-assisted intellectual property enforcement. A technical network of more than 90 experts is examining existing systems and identifying gaps. The initiative assesses technical feasibility and interoperability; its remit does not include creating binding rules. The feature explains that this infrastructure could affect litigation evidence, rights reservations and licence negotiations and audits, while leaving legal questions about consent, infringement, enforcement and remuneration unresolved.
