Texas has become a prominent state in regulating data privacy and artificial intelligence, adopting the Texas Data Privacy and Security Act (TDPSA) in 2023, which applies broadly to any company processing personal data of Texas residents. The Texas Attorney General actively enforces these laws, with significant penalties for violations. In 2025, Texas also passed the Texas Responsible Artificial Intelligence Governance Act (TRAIGA), regulating generative AI and prohibiting its use for harmful activities such as manipulation, discrimination, and social scoring. The law establishes a Texas AI Council to oversee ethical AI development.
